Mahkamah Benar Permohonan Bekas Timbalan Presiden KOM Ketepi Perintah Penggantungan


KUALA LUMPUR, 29 Nov (Bernama) -- Mahkamah Tinggi di sini Jumaat membenarkan permohonan bekas Timbalan Presiden Kesatuan Olahraga Malaysia (KOM) Datuk Karim Ibrahim untuk mengetepikan perintah penggantungannya selama enam tahun daripada aktiviti olahraga yang dikenakan KOM terhadapnya pada tahun lepas.

Hakim Datuk Zaleha Yusof memutuskan bahawa berdasarkan perlembagaan KOM, plaintif bukanlah ahli persatuan itu.

"Prosiding disiplin yang dikenakan terhadap plaintif adalah perkara yang serius dan memandangkan plaintif bukan ahli persatuan, KOM tidak boleh mengambil tindakan terhadapnya," katanya.

Hakim Zaleha tidak menetapkan sebarang kos.

Pada 1 April lalu, Karim yang juga naib presiden Persatuan Olahraga Melaka, memfailkan saman pemula terhadap KOM untuk memohon satu deklarasi bahawa beliau bukan ahli KOM.

Karim memohon diketepikan keputusan dan perintah KOM bertarikh 11 Okt 2012 yang menggantungnya bagi tempoh enam tahun daripada melakukan sebarang aktiviti sukan olahraga.

Dalam samannya itu, beliau turut memohon mahkamah membuat penentuan sama ada KOM mempunyai bidang kuasa untuk membuat perintah penggantungan itu walaupun beliau bukan ahli KOM mengikut Perlembagaan Terpinda dan Undang-Undang Kecil KOM bertarikh 25 Julai 2011.

Beliau digantung oleh KOM selepas didapati bersalah bersubahat dalam kes enam atlet melarikan diri daripada ujian anti-doping pada 2011 dan keputusan itu dicapai oleh ahli majlis KOM selepas meneliti laporan siasatan kes berkenaan yang dipengerusikan oleh bekas hakim Mahkamah Rayuan Tan Sri V.C George.

Karim, yang diwakili peguam Didiana Zakaria hadir dalam prosiding hari ini manakala KOM diwakili peguam Alex De Silva dan Adlan Hadi Mohamad Yusof.

Rajagobal Let Off The Hook

PETALING JAYA, April 24 (Bernama) -- National head coach Datuk K. Rajagobal was let off the hook by the Football Association of Malaysia's (FAM) Disciplinary Committee after finding no evidence that he had violated FAM's Article 88, as claimed. FAM Disciplinary Committee chairman Datuk Taufik Abdul Razak said the committee had decided not to charge Rajagobal after carefully analysing the video of the post-match press conference by the 56-year-old coach.
